How do I find an Indian patent by application
number?
Enter the application number directly in the search box.
Post-2016 numbers use the format IN·YYYY·J·T·NNNNNN — e.g. IN202541000123 (2025, Chennai, Ordinary, serial 000123). Pre-2016 numbers
appear as 1234/DEL/2010. You can also search by title, abstract, or applicant
name and filter by filing date.
What is Form 18 in Indian patent prosecution?
Form 18 is the Request for Examination — without it, the Indian Patent Office will not examine your application. It must be filed within 48 months of the priority date. Form 18A is for expedited examination (higher fee). Failure to file within the deadline results in the application being treated as withdrawn.
How long does Indian patent examination take?
After filing Form 18, the FER is typically issued in 12–24 months (standard) or 6–12 months (expedited, Form 18A). Total prosecution time from filing to grant has historically averaged 4–6 years, but has improved with recent IPO modernisation drives. Expedited examination reduces this significantly for qualifying applicants.
What is the difference between a provisional and
complete specification?
A provisional specification secures a priority date early but does not contain claims. The complete specification (with claims) must follow within 12 months. Patents are only examined and granted on the complete specification. Filing provisionally first is a common strategy to establish priority while finalising the invention.
What inventions cannot be patented in India?
Section 3 of the Patents Act, 1970 excludes: abstract theories, natural discoveries, mathematical methods, mental acts, business methods, computer programs per se, literary/artistic works, traditional knowledge, and new forms of known substances without enhanced efficacy. Software is patentable only if it produces a technical effect beyond normal physical computer interactions.
Can foreign companies file patents in India?
Yes. Foreign individuals and companies can file Indian patents directly or through the PCT (Patent Cooperation Treaty) national phase. Foreign applicants must appoint an Indian patent agent registered with the IPO. India is a member of the Paris Convention, so foreign filers can claim priority from earlier national/regional filings within 12 months.
